Window scaling is used even though the server did not include it in the options
#1 Client SYN:
Options: (20 bytes), Maximum segment size, SACK permitted, Timestamps,
No-Operation (NOP), Window scale
Window scale: 2 (multiply by 4)
#2 Server SYN+ACK:
Options: (4 bytes), Maximum segment size
#3 Client ACK:
Window size value: 5840
Calculated window size: 23360
#5 Server ACK:
Window size value: 8190
Calculated window size: 8190
#174 Client ACK:
Window size value: 65535
Calculated window size: 262140
#216 Server sent a bunch of packets
Bytes in flight: 65535
At that moment we should see window full next to this packet but we don't.
However wireshark 1.10.8 does show it:
#196
The transmission window is now completely full
Attached is the pcap of the traffic
