As you have Cygwin installed, remove "scanner.c" and rebuild. 
Apparently the version of Flex used when constructing the 0.9.4 and
0.9.5 source tarballs generates code that cannot be compiled on Win32;
the version of Flex that comes with Cygwin (if you don't have Flex, you
may have to find the right part of Cygwin to install to get it; if you
do have it, and nmake doesn't find it, you may have to change your path
to include the directory that contains it).

As of Ethereal 0.9.5, you must have the 2.3 version of the WinPcap
developer's pack; Ethereal 0.9.5 will *not* compile with older versions.

If you don't have WinPcap 2.3 installed, un-install it and install 2.3.

If you don't have the 2.3 version of the developer's pack installed,
remove the developer's pack, download the 2.3 version, and install it.
